Terms and Conditions

The agreement between our client and Cake Corner is based on these terms.

We view these Terms, your Order, and the Order confirmation as constituting the entirety of our relationship with you regarding the purchase of cakes. Since this is the document, we use to complete your order, it is your obligation to ensure that all the details are correct and full.


Basis of Sale

Any samples, drawings, or descriptions we issue, and any descriptions or illustrations contained on our website and social media are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Cake Corner.

Quotations are valid for a period of 14 calendar days from the day of issue. Cake sizes quoted are in inches and are based on the diameter of the cake. Cakes are 4 inches deep as standard. If you would like a deeper cake this needs to be requested at the time of booking.

No contract is made with you until we have received your booking fee. Once your booking fee has been received you are in a legally binding contract with Cake Corner.


The Cakes

We warrant that on delivery or collection the Cakes shall conform to their description as set out in the Order Confirmation, be of satisfactory quality, and comply with all food safety, statutory and regulatory requirements in the UK.

We will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre-agreed requirements set out in the order confirmation and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation are correct and meet their exact requirements.

The warranty does not cover any faults in the cakes that result from wilful damage, accidents, negligence on your side or that of any other person, from using the cake improperly, from failing to adhere to our instructions, or from any adjustments you make.

Our cakes are made in an environment where nuts, egg, milk, gluten, and other allergens are present. We cannot guarantee that any cake is entirely nut-free although we make every effort to ensure that allergies are accommodated.

We cannot guarantee an exact replica of any cake, we'll try our best. When colour samples are provided, we'll try to match them as closely as we think is practical; however, exact colour matches are not guaranteed.

Fresh flowers are not recommended, and not included in the price of any wedding cake design. If a wedding cake is to be decorated with fresh flowers these are to be provided by your florist; however, please note some flowers are not suitable for use as a cake decoration as they can be an irritant, they may be sprayed with pesticides, and some are poisonous, therefore, not advisable. Ask your florist for details regarding toxicity. We cannot be liable for any contamination of our food products that may arise from their misuse.

Certain components used in our cakes could occasionally become obsolete. Although we have no control over this, we will try our best to choose replacement products that as closely resemble the original design as possible. Without prior consent, we have the right to substitute things with component parts of comparable or higher quality.

If your cake contains figures made from sugar, whilst edible, we do not advise that they be eaten, due to the possible presence of dowels for reinforcement. All of our figures are handmade, and therefore, whilst we try to capture the characteristics of a particular person if requested (such as with eye colour, hair colour, hair length, glasses, etc), we cannot guarantee a true likeness. It is your responsibility to provide images for our reference. If images are not provided standard figures shall be used. Images need to be provided no later than 8 weeks prior to the event.

Dowels are placed in each tier of stacked cakes to provide stability; these should be removed before consumption

We have the right to presume consumption will be on the stated day as the cake is a fresh product without any additives or preservatives. Cakes should be kept covered in a dry area at room temperature, away from sources of heat and sunshine. They should not be kept in the fridge.

Cake Corner and the customer expressly agree that up until the balance is paid in full, all products acquired from Cake Corner remain Cake Corner property.


Delivery

The cake will be delivered to the agreed location by Cake Corner. By prior arrangement, some orders may be picked up from Cake Corner without charge. Once the cake leaves the premises, we accept no liability for any harm that may have occurred to it.

On the date specified in the order confirmation, we will deliver the cake to the specified address. We do not provide delivery times in advance. Although Cake Corner will always try its best to deliver the items or provide the services by the agreed-upon dates, we cannot be held responsible for delays, and time is not of the essence.

After the order has been confirmed, if the delivery address changes, additional fees to cover additional mileage may be applied.

When delivering to a wedding venue, we will contact the venue in advance to set up a time that works for all parties. If we set up the wedding cake, we will take a picture of it before we leave and, if at all feasible, have the venue to sign off that the cake was received in good condition. If the venue needs to set up the cake themselves, we will provide instructions and, if at all possible, collect a signature to confirm that we have done so. After the cake has been delivered, we are unable to accept responsibility for any further damage the cake may receive or for any failure to adhere to the given instructions.

If the order includes the hire of a cake stand, a security deposit will be payable with the final balance. The stand must be returned to us in a good, clean condition within 3 days of the wedding. Upon the return of the stand, the deposit will be refunded. This will be refunded via bank transfer with 5 working days. Should the stand be returned broken or damaged, the cost of the replacement stand will be deducted from the security deposit.

Price and Payment

The price of your cake will be as set out in your order confirmation. A 50% deposit is required on booking, with the remaining balance to be paid 3 weeks prior to the event. A detailed order confirmation will be issued detailing the final balance and payment details. No further payment reminders will be sent, and it is the responsibility of the client to ensure payment is on time.

We may be able to accommodate orders that are booked at short notice; however, full payment will be required on booking.

Please note all booking fees are non-refundable.

The balance must be paid in cleared monies no later than the date set out in the order confirmation by bank transfer to the account specified.

If payment is not received by the date specified this shall be constituted as a breach of contract by the client. We reserve the right to hold the order until payment is made in full. When payment is late, we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances, the cake will be made as close to the order confirmation as possible with no redress or liability on Cake Corner.


Cancellation, postponement, and alterations

In the event of a cancellation by yourselves, charges are as follows:

  • More than ninety days prior to the date = booking fee only.
  • Ninety days to one calendar month prior to the date = booking fee plus half the remaining cost.
  • Less than one calendar month prior to the date = full amount
  • Any booking fees previously paid are non-refundable.

The amount owed in the case of a wedding postponement is the same as for a cancellation. If you change your mind less than 90 days before the wedding, half of the remaining fee is required on the scheduled payment date. If you decide to postpone less than a month before the wedding, the remaining balance is still due on the original due date. Any payments made will be applied to the new wedding date, pending availability. We will only do this once, so please be aware of that. Any more delays will be regarded as cancellations. Depending on the length of the deferral, costs may also grow, rising in line with the annual cost of inflation.

You can make changes to your order by giving us written notice no less than 8 weeks before the wedding, or 14 days for celebratory cakes. If there are changes, a new order confirmation will be sent out describing them and the new price. Until a new order confirmation has been sent, changes are not confirmed. Even if your new design is less expensive than the initial booking, there will be no price reduction if you make any modifications after the time frame outlined above.

If you are collecting your cake order but for some reason fail to do so, we have the right to pursue legal action to recoup any unpaid balances.

In the event of unforeseeable events such as (without limiting the generality of the foregoing): fire, floods, storms, plant breakdowns, strikes, lockouts, riots, hostilities, the non-availability of materials or supplies, or any other event beyond Cake Corner's control, Cake Corner reserves the right to cancel, modify, or suspend the operation of this contract. Cake Corner shall not be liable for any breach of contract as a result of such an event. We will provide you written notice in this case, but any booking costs paid are not refundable. We also make reference to our cancellation policy.

As such we advise you to purchase wedding insurance. 

Cake Corner's liability for defects in goods or services, whether in contract or tort, is restricted to the issuance of a credit note in connection therewith, the granting of a refund, or other similar compensatory measures that Cake Corner, in its discretion, considers appropriate in the circumstances and is limited to the value of the goods or services giving rise to the claim.

Cake Corner will not be held responsible for a customer's indirect consequential loss or damage or loss of profits, provided that these terms do not limit or waive Cake Corner's legal responsibility for death or personal injury resulting from its negligence or from statutory implied terms in consumer contracts.

Complaints –

Whilst complaints are extremely rare, we do take complaints very seriously given the amount of work that goes into each handmade cake. Any problems must be reported to us within 48 hours after collection or delivery in order to give us a reasonable chance to determine the substance of the complaint.

Without giving the other party prior written notice of the intended content of such posting and giving the other party the chance to settle any disputes between the parties amicably, both Parties agree to refrain from posting any disparaging remarks about the other arising out of this contract or the event on any online forum or website.

Complaints regarding the decoration of celebration cakes can be easily rectified; therefore, errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once payment has been handed over this confirms that decoration is as requested, and no further claims can be made. When booking, clients will be sent an order form which details their cake. It is the client’s responsibility to check that this meets with their requirements and raise any issues with us if there are any discrepancies.

If a complaint relates to the quality of the cake, the cake must be returned to us as soon as possible after cutting and within 48 hours of pickup or delivery. This will allow us to fairly evaluate the complaint's nature.

Please note we can only deal with the client who placed the original order.


Basic Terms

The ownership of all designs and intellectual property rights remains with Cake Corner.

We reserve the right to use pictures of your cake in any type of advertising, including contests, galleries, and web-based promotions. You should make a copy of everything you receive from Cake Corner for your own benefit.

The parties' agreement and understanding on the order are fully expressed in this Agreement and the Order Confirmation documents that have been given. All earlier agreements, statements, representations, understandings, negotiations, and conversations between the parties, whether oral or written, are superseded and cancelled by this Agreement, unless clearly indicated otherwise. Each of the parties acknowledges and agrees that, except to the extent that such statement, representation, warranty, or understanding is incorporated into this Agreement, it did not rely on any statement, representation, warranty, or understanding made prior to this Agreement in entering into this Agreement. Each of the parties acknowledges and accepts that it did not rely on any statement, representation, warranty, or understanding made previous to this Agreement in order to enter into this Agreement or was otherwise persuaded to do so. Nothing in this sentence disclaims culpability for deceptive representation.

The validity and enforceability of the remaining valid and enforceable provisions of this Agreement shall be construed as if such invalid or unenforceable provisions had not been inserted, in the event that one or more of the aforementioned provisions of this Agreement should be found to be invalid or unenforceable.

The use of any headings in this Agreement is only for the purpose of ease of reference and shall not limit or otherwise affect the interpretation of the terms and conditions hereof.
